What the source report of this graph actually shows is not “use” but sentencing. And what the report explains is that african americans receive much harsher punishment than do whites concerning basically the same drug (cocaine).

The sentencing is set by mandatory federal guidelines, there is no discretion allowed that I am aware of.

Crack cocaine users receive harsher punishment under Fed mandatory minimum for that particular substance not a particular race or ethnicity.
